Please read these Terms of Use ("TOU") carefully. These TOU apply to your viewing or use of the website to which this privacy notice is attached (“Website”) . By visiting or using this Website, you agree to these TOU. References in these TOU to "you," "your," or variations thereof shall mean individual users of this Website together with your employer, and references to "CCC," "we," "our," "us," or variations thereof shall mean CCC Information Services Inc. and its affiliates.

  1. Purpose

This Website and its services are only for use by prospective and current customers of products or services offered by CCC.

  1. Privacy Policy

Use of this Website is governed by CCC’s Privacy Notice (found here: https://cccis.com/privacy-policy/). Your use of this Website signifies your agreement to the Privacy Notice.

  1. CCC Customer Agreement

Any agreements that exist between CCC and your employer (collectively, “Customer Agreement”), shall apply to your use of this Website. In the event of any conflict between the Customer Agreement and these TOU, these TOU will control. These TOU, the Privacy Notice, and the Customer Agreement, along with any legal notices published by CCC on this Website or provided in Responsive Information, shall constitute the entire agreement between you and CCC regarding this Website and your use of this Website. Terms of the TOU that by their nature are intended to survive termination or expiration of the TOU, shall so survive.

  1. Rules for user conduct and use of this Site

These Terms and Conditions apply whenever you use or access of this Site. You solely are responsible for User Content that you upload, publish, display, link to or otherwise make available (hereinafter, "post") on this Site. User Content is defined as any communications, images, sounds, and all the material, data, and information that you upload or transmit, or that other users upload or transmit, including, without limitation, any comments. You agree that CCC is only acting as a passive conduit for your online distribution and publication of your User Content. Your permission to use this Site is conditioned upon the Use Restrictions and the Posting and Conduct Restrictions below. 

  1. Use Restrictions

You will only use this Site for your own benefit. You agree that you will not under any circumstances:

  • post any information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable and offensive;
  • use this Site for any unlawful purpose or for the promotion of illegal activities; attempt to or harass, abuse or harm another person or group;
  • use another user's account ;
  • provide false or inaccurate information when registering an account;
  • use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content;
  • interfere or attempt to interfere with the proper functioning of this Site;
  • make any automated use of the system, or take any action that CCC deems to impose or to potentially impose an unreasonable or disproportionately large load on CCC's servers or network infrastructure;
  • bypass any robot exclusion headers or other measures CCC takes to restrict access to this Site or use any software, technology, or device to scrape, spider, crawl, or harvest or manipulate data;
  • use the communication systems provided by or contacts made on this Site for any commercial solicitation purposes; and
  • publish or link to malicious content intended to damage or disrupt another user's browser or computer.

Posting and Conduct Restrictions. The following rules pertain to User Content. By transmitting and submitting any User Content while using or accessing this Site, you agree, represent and warrant as follows:

  • You will comply with these Terms and Conditions;
  • You are solely responsible for your account and the activity that occurs while signed in to or while using your Site account;
  • You own or have the necessary licenses, rights, permissions, and consents to use and authorize CCC to use any and all User Content submitted by you to this Site;
  • You will not submit content that is copyrighted or subject to third party proprietary rights, including privacy, publicity, trade secret, etc., unless you are the owner of such rights or have the appropriate permission from the rightful owners to specifically submit such content to this Site; and
  • You hereby affirm CCC has the right to determine whether any of your User Content submissions are appropriate and comply with these Terms and Conditions, remove any and/or all of your submissions, and terminate your account with or without prior notice.
  • CCC takes no responsibility and assumes no liability for any User Content that you or any other user or third party post or send over this Site. You understand and agree that any loss or damage that occurs as a result of the use of any User Content that you make available or access through your use of this Site is solely your responsibility. CCC is not responsible for any public display or misuse of your User Content.
  • CCC does not and cannot pre-screen or monitor all User Content. However, at CCC's discretion, CCC or technology that CCC employs may monitor and/or record your interactions with this Site.
  • Though CCC strives to enforce its Terms and Conditions, you may be exposed to content that is inaccurate or objectionable. CCC reserves the right, but is not obligated, to limit or deny a user's access to this Site or take other appropriate action if a user violates these Terms and Conditions or engages in any activity that violates the rights of any person or entity or which CCC deems unlawful, offensive, abusive, harmful or malicious. Unauthorized use may result in criminal and/or civil prosecution under federal, state and local law.

  1. License Grant

By posting any User Content, you expressly grant, and you represent and warrant that you have a right to grant, to CCC a royalty-free, sub-licensable, transferable, perpetual, irrevocable, nonexclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice and/or likeness as contained in your User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with this Site.

  1. Intellectual Property

This Site and domain are owned by CCC. You acknowledge and agree that CCC and CCC's licensors retain ownership of all intellectual property rights of any kind related to this Site, including applicable copyrights, trademarks and other proprietary rights. Other product and company names that are mentioned on this Site may be trademarks of their respective owners. CCC reserves all rights that are not expressly granted to you in in these Terms and Conditions.

  1. Links to other Sites and/or Materials

As part of this Site, CCC may provide you with convenient links to third party websites. These links are provided as a courtesy to Site visitors. CCC has no control over linked websites or the promotions, materials, information, goods or services available on these third party websites. CCC is not responsible for and does not endorse or warrant any materials, information, goods or services available through any linked websites or any privacy or other practices of such websites. CCC may terminate any link at any time.

  1. Accuracy of Information

CCC strives to accurately describe the APIs and provide updated information. However, CCC does not warrant that descriptions of APIs, its products and services, or information this Site are current, complete or free from error. Moreover, to the extent that content displays licensed from third party sites, only those third party content suppliers are responsible for the accuracy or completeness of the content they make available.

  1. Email may not be used to provide notice to this site

Communications made through the Site e-mail and messaging system will not constitute legal notice to CCC or any of its officers, employees, agents or representatives in any situation where notice to CCC is required by contract or any law or regulation.

  1. User consent to receive communications in electronic form

For contractual purposes, you (a) consent to receive communications from CCC in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that CCC provides to you electronically satisfy any legal requirement that such communications would satisfy if they were in writing. The foregoing does not affect your non-waivable rights.

You represent, covenant, and warrant that you have full authority to access this Website and make binding agreements. You are responsible for obtaining any and all consents necessary to provide information to this Website and for the use of that information by CCC to fulfill the purpose of this Website, this TOU, or the Privacy Notice. You represent, covenant, and warrant that all information you provide to this Website will be accurate and complete and does not infringe the rights of third parties.

You assume full responsibility and risk of loss resulting from your downloading and/or use of files, information, content, or other material obtained from this Website.

To the maxim extent provided by applicable law, CCC and its officers, directors, employees, agents, licensors, and partners shall not be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages (including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses) that result from access or use of this Website (including access or use in violation of these TOU) or any information provided from this Website or any information provided in response to requests made on this Website.
